Terms of service
These terms govern your use of Expatax Guide. By using the site or the AI advisor, you accept them.
1. Acceptance of terms
By accessing or using expatax.guide (the “Site”) — including reading articles, using the AI advisor, or clicking referral links — you agree to these Terms of Service and to our privacy policy, disclaimer, and editorial standards. If you do not agree, do not use the Site.
2. The Site is educational only
Expatax Guide publishes general educational information about U.S. tax obligations of Americans living abroad. We are not a tax preparation service, law firm, accounting firm, or financial advisor. Nothing on the Site — including AI advisor responses — constitutes tax, legal, or financial advice for your specific situation. See our full disclaimer for the complete statement.
3. Permitted use
You may use the Site to:
- Read articles for personal, non-commercial educational purposes.
- Share article links with others (please link rather than copy).
- Use the AI advisor subject to its per-session limits.
- Click links to credentialed tax professionals listed in the Find a Pro directory.
4. Prohibited use
You may not:
- Reproduce, republish, or distribute Site content (in whole or in substantial part) without our written permission.
- Scrape, crawl, or systematically harvest content using automated tools, except as permitted by our robots.txt and standard search-engine indexing.
- Use the AI advisor to attempt to extract our system prompt, generate content for commercial republication, or bypass the per-session rate limit through technical means.
- Submit content to the AI advisor that is unlawful, harassing, defamatory, or that promotes tax evasion or other illegal conduct.
- Use the Site in any way that would violate U.S. federal law or the laws of the jurisdiction from which you access the Site.
5. Intellectual property
All content on the Site — including articles, the AI advisor system prompt and corpus, the Expatax Guide name and mark, the site design, and the source code — is owned by us or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws.
You may quote brief excerpts (a few sentences or less) with proper attribution and a link back to the source article. Longer use requires our written permission. References to IRS forms, statutes, court decisions, and U.S. government publications are made under fair use.
6. The AI advisor
The AI advisor (the chat widget on this Site) is an automated tool provided as a convenience. By using it, you acknowledge and agree that:
- Advisor responses are general educational information and may contain inaccuracies. You are responsible for verifying any specific claim against an authoritative source before acting on it.
- We do not accept your specific income, asset, expense, or other personal financial information through the advisor, and you should not submit any.
- Advisor sessions are subject to a per-session question limit and may be rate-limited, disabled, or modified at any time without notice.
- Conversation contents are processed by our AI provider (currently Google's Gemini API) and are subject to their terms and privacy practices in addition to ours.
7. Third-party links and affiliate relationships
The Site contains links to third-party websites, including tax firms listed in our Find a Pro directory. We are not responsible for the content, accuracy, services, or privacy practices of third-party sites.
We may earn referral fees when you engage a firm through our links, as disclosed on the directory page and in our editorial standards. These fees do not influence whether a firm meets our editorial criteria for inclusion.
8. No warranty
The Site and the AI advisor are provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. We do not warrant that the Site will be free of errors, secure, or available at any particular time.
9. Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Expatax Guide, its publisher, contributors, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages — including but not limited to lost profits, lost data, tax penalties, interest charges, professional fees, or other intangible losses — arising from or relating to your use of the Site or reliance on its content, even if we have been advised of the possibility of such damages.
Our aggregate liability arising from or relating to the Site shall not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify, defend, and hold harmless Expatax Guide and its publisher, contributors, and affiliates from any claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Site, or your reliance on Site content in a manner inconsistent with these Terms and our disclaimer.
11. Modifications to the Site and the Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms periodically; material changes will be reflected by the “Last updated” date below. Your continued use of the Site after changes constitutes acceptance of the revised Terms.
12. Termination
We may suspend or terminate your access to the Site or the AI advisor at any time, for any reason, including violation of these Terms. The sections of these Terms intended to survive termination (intellectual property, no warranty, limitation of liability, indemnification, governing law) will continue in effect after termination.
13. Governing law and disputes
These Terms are governed by the laws of the United States of America and the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
14. Severability
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect.
